NEW YORK (AP) — A motorcyclist accused of instigating an encounter with an SUV on a New York City highway that ended with the SUV driver being chased and beaten is due in court Wednesday for arraignment.

Christopher Cruz of Passaic, N.J., faces charges of reckless endangerment, reckless driving, endangering the welfare of a child and menacing.

The Manhattan district attorney's office says it decided not to prosecutor Allen Edwards of Queens, a second motorcyclist taken into custody Tuesday.

An Internet video shows a group of bikers surrounding the SUV on the West Side Highway on Sunday after an altercation. The SUV driver took off, plowing through the crowd. Police say the bikers chased the driver, ambushed his car and attacked him.

The driver needed stitches. His wife and toddler were in the car but weren't injured.
